The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 342, 506 and 354/34 of the Indian Penal Code. It is alleged that petitioner no. 2 Ranjeet Sah took the daughter of the daughter to his house and tried to outrage her modesty. It is alleged that petitioner no. 1 Chandrika Sah instigated petitioner no. 2.

It is submitted by learned counsel for the petitioners that for a petty dispute the accusation has been levelled and subsequently the daughter of the informant eloped

Patna High Court Cr.Misc. No.44844 of 2015 (3) dt.30-10-2015 2/2 with Vikky Kumar for which Chapra Muffasil P.S. Case No. 41 of 2015 was registered.

A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of petitioner no. 2, if he surrenders before the learned court below within a period of six weeks from today.

So far as petitioner no. 1 is concerned, since thrust of accusation is against petitioner no. 2, let the above named petitioner no. 1 be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 23 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
