The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354A, 379 and 504/34 of the Indian Penal Code.
The prosecution case is that the petitioners caught hold of the informant when she went to attend call of nature. Subsequently the petitioners escaped from the scene. It is further alleged that when the father, uncle and aunt of the informant went the house of the petitioners to make protest then the petitioners assaulted the informant and her sister. The
Patna High Court Cr.Misc. No.44967 of 2015 (3) dt.02-11-2015 2/3 informant received serious injuries and her ear-ring was snatched.
It is submitted by learned counsel for the petitioners that for the occurrence of 10.03.2015 at 6.30 A.M. the FIR was lodged on 13.03.2015 at 9.30 A.M. which reached to the court of learned Incharge CJM on 17.03.2015 which reflects that the FIR has been registered antedating. All the six persons of the informant side have received superficial injury and one Chintu Devi, agnate of the petitioners, Chandi P.S. Case No. 23 of 2015 making accusation under Sections 147, 323, 354A, 307, 448, 379 and 504 of the IPC against the husband of the informant and others on 13.03.2015 at 9.00 A.M. then at 9.30 A.M. the present FIR has been lodged.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the delayed lodging of the case and the accusation being omnibus and general, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist
