JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2017 By way of present modification application, the petitioeners seek to modify the order, dated 24.10.2011 passed in Criminal Miscellaneous No. 32498 of 2011.

Learned counsel for the petitioners submitted that at the time of granting anticipatory bail, some conditions were imposed upon the petitioners and among other conditions one of the conditions was that "the petitioners will remain present in course of trial on each and every day and their absence even for a single day would automatically entail the consequence of cancellation of their bail". Learned counsel for the petitioner further submitted that since the petitioners are poor persons and live in Mumbai to earn their livelihood some relief may be granted to them by modifying the order, dated 24.10.2011, aforementioned. Considering the facts and circumstances of the case so far the condition no. 2, as stated above, the same is modified to the

Patna High Court Cr.Misc. No.49483 of 2016 (3) dt.11-01-2017 2/2 extent that; petitioners will remain present in course of Trial on each and every day except on showing some genuine reasons. With the observations as above this application is, accordingly, disposed of.
