2. In this case, the petitioner is seeking regular bail in connection with Areraj P.S. Case No. 50 of 2024, registered for the offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per allegation, seeing the police, five accused persons fled away after throwing plastic bags containing altogether 42.5 litres of country made liquor.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. Nothing has been recovered from the conscious possession of

Patna High Court CR. MISC. No.58942 of 2024(2) dt.27-08-2024 2/2 the petitioner. The petitioner is under custody since 24.06.2024 and he is a person of clean antecedents.

5. On the other hand, learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, East Champaran at Motihari in connection with Areraj P.S. Case No. 50 of 2024, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
