JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Rajpur P.S. Case No. 140 of 2016 for the offences instituted under Sections 406, 409, 420 and 120(B) of the Indian Penal Code.
The allegation against the petitioner is that being Panchayat Secretary, he did not make available the relevant files relating to appointments of Panchayat teachers in the said gram panchayat, which were made during the previous years. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering of witnesses alleged against the
Patna High Court Cr.Misc. No.42960 of 2016 (4) dt.15-12-2016 2/2 petitioner. The petitioner has been made accused due to mistake of fact. The petitioner has already deposited the documents relating to the appointments of the panchayat teachers, which were handed over to him by his predecessor.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, the provisional bail granted to the petitioner vide order dated 24.10.2016 is hereby confirmed.
