JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Bodh Gaya (Cherki) P.S. Case No. 87 of 2008 for the offences instituted under Sections 323, 324, 307, 379, 448, 450 and 302/34 of the Indian Penal Code.

The allegations against the accused persons are that they entered into the house of the informant having armed and assaulted the members of the prosecution side and accused Parshuram Paswan took away Rs. 3000/- also.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court Cr.Misc. No.48622 of 2016 (3) dt.24-11-2016 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners are named in the F.I.R. In course of investigation, final form was submitted. The said final form was accepted by the court below and no cognizance was taken against the petitioners. Subsequently, in course of trial, summon has been issued against them under section 319 of the Cr.P.C. General and omnibus allegation has been made against the petitioners. On behalf of the State, it has been submitted that the present application has been preferred after issuance of summon under Section 319 of the Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with S. Tr. No. 456 of 2010, arising out of Bodh Gaya (Cherki) P.S. Case No. 87 of 2008 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
