JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-08-2017 Heard learned counsel for the petitioners, learned counsel appearing on behalf of O.P.No.2 and the learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Compliant Case No. 1143 (C) of 2014, registered under Sections 120B, 420, 467, 468, 147, 148, 427 and 379/34 of the Indian Penal Code. The accusation is that Navi Yadav, grand-father of complainant/O.P. No.2 Domi Yadav and Chamu Mandal, grand-father of petitioner No.1 were own brother. On partition, the residential campus and orchard were allotted to the share of grandfather of the Domi Yadav and petitioner No.1 with intention to cheat him executed the sale deed regarding said land in favour of his grandsons petitioner
Patna High Court Cr.Misc. No.17145 of 2017 (3) dt.18-08-2017 2/2 No.3 and petitioner No.4, both are sons of petitioner no.2. Learned counsel for the petitioners submits that, in fact, in Jamabandi area of plot is 2 Acre and 27 decimals out of the said plot only in respect to 9 decimal land is sold by the petitioner No.1 favour of both grand sons i.e. Petitioner No.3 and 4, but with ulterior motive the complainant, who is pattidar of the petitioners has lodged this false case.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-1st, Supaul in connection with Complaint Case No. 1143(C) of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
