This is an application for grant of anticipatory bail for the offences punishable under Sections 147, 148, 149, 323, 307, 379/504 of the Indian Penal Code.

The allegation against the petitioner is that he assaulted by rod to one Bishundeo Ram.

It has been submitted on behalf of the petitioner that the allegation of assaulting Bishundeo Ram by Gadasa blow is against one Chandan Yadav and this Court after considering the matter granted anticipatory bail to Chandan Kumar vide order dated 26.09.2016 passed in Cr. Misc. No. 35460 of 2016. Having heard both sides and in view of the fact that

No.51735 of 2016 (2) dt.20-12-2016 2/2 the co-accused, on similar allegation of assault, has already been granted bail by this Court, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Nawada in connection with Kashichak P.S. Case No. 22 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
