The petitioner apprehends his arrest in connection with Turkauliya (Banjariya) P.S. Case No.205 of 2015 registered under Sections 406, 409, 420, 467, 468 and 120(B) of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Motihari, East Champaran.
The accusation is that Rajiv Ranjan, the District Programme Officer, Ruabja Khatoon, Mukhiya, Ash Mohmad Mian, Mukhiya, Krishna Dubey (petitioner), Panchayat Rojgar Sewak, Lal Babu Sah, Post Master, Sunil Kumar Jha, P.T.A. and
Patna High Court Cr.Misc. No.47135 of 2016 (6) dt.04-04-2017 2/2 Md. Atiullah, J.E., under conspiracy withdrew Rs.1,51,200/- by cheque on 04.09.2012 through forged accounts of labouers under MANREGA Scheme No.01/09-10 to 12/09-10.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the cheque was issued by Rajiv Ranjan, the District Programme Officer and this petitioner had simply forwarded the name of the workers for depositing the wages in their accounts. Further submission is that Ruabja Khatoon and Ash Mohammad Mian alias Ash Mohmad, vide order dated 28.09.2015 passed in Criminal Misc. No.39435 of 2015, and Lal Babu Sah, vide order dated 16.12.2015 passed in Criminal Misc. No.55261 of 2015, have already been granted anticipatory bail by different Benches of this Court.
Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
