The petitioner apprehends his arrest in connection with Paraiya P.S. Case No.64 of 2015 registered under Sections 147, 148, 149, 341, 323, 504, 324, 307, 379 and 506 of the Indian Penal Code. The accusation is that seven persons named in the F.I.R., including the petitioner, reached at the house of the informant, Fugal Kumar, and started to abuse the informant in filthy language. When the informant made protest then the petitioner gave scissor blow causing injury on his right chest and other accused also caused injury to him through fists and slaps. At that time, the co-accused, Suryadeo Thakur, snatched the silver chain from the neck of the informant. Learned counsel appearing on behalf of the petitioner submits

Patna High Court Cr.Misc. No.45637 of 2015 (2) dt.15-10-2015 2/2 that, in fact, on the date of occurrence the informant of the present case and others caused injury to the petitioner and others due to lodging of Paraiya P.S. Case No.28 of 2015 lodged by Shambhu Sharma, the cousin of the petitioner, regarding which Paraiya P.S. Case No.63 of 2015 was lodged by the petitioner. Moreover, there is general allegation against the other accused to cause injury to the informant with fists and slaps with specific allegation against the petitioner to cause injury through scissor at the chest of the informant but the injury caused to the informant by the petitioner is simple in nature.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Gaya, in connection with Paraiya P.S. Case No.64 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S.
