JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2018 Heard learned counsels for the petitioners and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 406 and 409 of the IPC.

The accusation against the petitioner is that she received Rs. 35,000/- for construction of Indira Aawas, but she failed to construct the same.

It is submitted by learned counsel for the petitioner that the petitioner has received only first installment from which some construction materials have been purchased and on payment of other two installments under the Indira Aawas Scheme, she will construct house. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

No.1456 of 2018(2) dt.11-01-2018 2/2 Considering the nature of accusation and the petitioner being the lady, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned SDJM, Saharsa in connection with Mahishi (Jalai O.P.) P.S. Case No. 78 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
