The petitioners apprehend their arrest in Bhabhua (Sonhan) P.S. Case No. 330 of 2016, registered for the offences punishable under Sections 366A/ 34 of the Indian Penal Code. The informant alleged that his daughter had gone to attend the call of nature but she did not return. The informant alleged that the petitioners along with other accused persons kidnapped his daughter.

Learned counsel for the petitioners submits that Ghurahu Ram and the victim were arrested by the police. The victim made her statement before the doctor. She disclosed that she fled away from her house with her boy friend and solemnized

Patna High Court Cr.Misc. No.39738 of 2016 (2) dt.19-09-2016 2/2 marriage with him. The victim also made her statement under Section 164 of the Cr.P.C. in which she disclosed a different story that four persons kidnapped her and committed rape with her. It appears that petitioners are brothers and father of Ghurahu Ram with whom the victim had fled away. Considering the facts aforesaid, the petitioner above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua (Sonhan) P.S. Case No. 330 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
