The petitioner apprehends his arrest in Bikramganj P.S. Case No. 155 of 2016 registered for the offences punishable under Section 7 of the Essential Commodities Act.

Five bags of rice were recovered from a vehicle bearing Registration No. BR-21P-0940. The driver of the vehicle unloaded the rice in village Indrarth Khurd and fled away with the vehicle. It is alleged that rice belongs to Krishna Kumar Gupta, the PDS dealer of village Kaster Mahadev.

Learned counsel for the petitioner submits that nobody has seen the petitioner selling the rice to the driver of the auto rickshaw and the stock was not verified.

No.46544 of 2016 (3) dt.22-12-2016 2/2 Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in Bikramganj P.S. Case No. 155 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
