The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363, 366 (A) /34 of the Indian Penal Code.

As per prosecution case, on the alleged date and time of occurrence, petitioner with the help of other co-accused persons kidnapped the daughter of the informant with intention to marriage. The victim girl is still trace less. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is no allegation of kidnapping against the petitioner rather the allegation is general and omnibus in nature. Petitioner bears fair antecedent.

Learned APP for the State has vehemently

Patna High Court CR. MISC. No.58118 of 2024(2) dt.18-09-2024 2/2 opposed the bail of the petitioner and submits that the petitioner is named in F.I.R. with specific accusation that he along with other accused persons kidnapped the minor daughter of informant who is still traceless.

Considering the aforesaid facts and circumstances of the case and also the fact that victim girl is traceless, the prayer for grant of anticipatory bail to the petitioner stands rejected.
