The petitioner is languishing in custody in a case registered for the offences punishable under Sections 25(1-B) a, 26, 35 of the Arms Act and Sections 8/20(B)(ii)(c), 22, 24 of the N.D.P.S Act.

It is alleged that on getting information that miscreants have assembled to distribute the money robbed from a bank, raid was laid and four accused persons iwere arrested and from their possession, country made pistol, charas were recovered. Apprehended person disclosed the name of petitioner as

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Neither the petitioner was apprehended on the spot nor anything incriminating from his conscious possession. His name sprang up in this case on the basis of confessional statement of apprehended co-accused persons. Moreover, he is languishing in custody since 30.03.2024. Similarly situated co-accused Kanhaiya Kumar has already been granted bail vide order dated 12.10.2023, passed in Cr. Misc. No. 49573 of 2023 by this Court.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
