2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 127(2), 115(2), 132, 109, 308(2), 308(4), 352, 351(2) and (3), 3(5) of BNS and Section 27 of Arms Act.
3. The allegation in the first information report is that the accused persons demanded extortion money of Rs. 5 lacs and all the accused persons assaulted Gopal Kumar, staff of the informant.
4. Learned counsel for the petitioner submits that the allegations in the FIR are general and omnibus in nature and to some extent the same is specific against Tuntun Yadav as he has been alleged to have fired, however, the said firing also did not

It has further been submitted that the co-accused Tuntun Yadav has already been granted bail by a coordinate bench of this Court vide order dated 27.11.2025 passed in Cr. Misc. No. 79302 of 2025 and the case of the petitioner stands on a better footing. Petitioner is in custody since 29.05.2025 and charge sheet has been submitted.
5. Learned APP for the State has opposed the application for bail on the ground that the petitioner has five criminal antecedents, however, in response to the same, it is submitted that the petitioner is on bail in all the cases.
6. Taking into consideration the facts and circumstances and also considering the fact that there is no specific allegation against the petitioner and co-accused Tuntun Yadav has already been granted bail by a coordinate Bench of this Court, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Khagaria in connection with Bharatkhand P.S. Case No. 29 of 2025, subject to the following conditions:- (i) one of the bailors of the petitioner shall be his father (ii) the petitioner shall co-operate in the trial and would appear on each and every date and in case of non-appearance on
