2. The petitioner is in custody in connection with Mali P.S. Case No. 43 of 2023 for the offence under Sections 341, 323, 337, 338, 307, 504, 506, 34 of the Indian Penal Code.

3. As per prosecution, deceased was brutally assaulted on the shop of the petitioner after he had an altercation with the petitioner. In course of treatment, the deceased had died after 1 and 1⁄2 months. From the postmortem report, it appears that the deceased was brutally assaulted and has sustained several injuries in his head which is the cause of death.

4. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 10.07.2023.

5. In view of the aforesaid fact, this Court is not

Patna High Court CR. MISC. No.56280 of 2023(2) dt.30-08-2023 2/2 inclined to grant bail to the petitioner.

6. Accordingly, the prayer of bail of the petitioner is rejected herewith.
