JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-03-2018 The petitioner seeks modification of the order dated 08.11.2016 passed in Cr. Misc. No. 47671 of 2016 whereby he was granted anticipatory bail, subject to his surrendering before the Court below within a period of four weeks. It has been submitted by learned counsel for the petitioner that because of the order not having been communicated to him in time, he could not surrender within the time frame fixed before the Court below. This was occasioned because the petitioner had gone out of the town for earning his livelihood. A prayer, therefore, has been made to extend the period of surrendering before the Court below and seeking bail.

For the reasons stated before this Court, the order

Patna High Court Cr.Misc. No.13324 of 2018 (4) dt.28-03-2018 2/2 dated 08.11.2016 passed in Cr. Misc. No. 47671 of 2016 is modified to the extent that the petitioner would now be required to surrender before the Court below within a period of two weeks from today, when he shall be granted bail on his furnishing bail bond of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Birpur, Supaul/concerned Court in connection with Birpur P.S. Case No. 54 of 2016. The order dated 08.11.2016 passed in Cr. Misc. No. 47671 of 2016 stands modified to the extent indicated above. The application stands allowed.
