The petitioners seek bail in Sabour P.S. Case No. 163 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition of Excise Act, 2016.

It is alleged in the written report that 571 litres of foreign liquor kept concealed under the stone chips has been recovered from tractor Dalla. As per written report, petitioners and co-accused Gulab Mandal started running away on seeing the Police party, but on chase, they were apprehended. Counsel for the petitioners submits that petitioners have been arrested in the instant case merely on suspicion. He

Patna High Court CR. MISC. No.49873 of 2019(2) dt.17-08-2019 2/2 further submits that co-accused Gulab Mandal has already been granted bail by coordinate Bench of this Court vide order dated 29.7.2019 passed in Cr. Misc. 46300 of 2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned IInd Additional District & Sessions Judge-cumSpecial Judge, Excise, Bhagalpur, in connection with Sabour P.S.
