JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dumariya P.S. Case No. 35 of 2011 registered under Sections302/34 of the Indian Penal Code. Petitioner is named in the first information report with allegation that he as well as others assaulted the informant's wife calling her "DAYAN" and due to the aforesaid assault, she died then and there.
Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail stands rejected. (Hemant Kumar Srivastava, J) A.K.V./- U T
