JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code and Section 8 of POCSO Act.

The present case was lodged against F.I.R. named accused, Dharmendra Yadav, who happens to be brother of the petitioner and the informant as well as victim stated the name of Dharmendra Yadav in course of investigation. However, the informant subsequently got recorded her statement and stated that it was petitioner, who committed the present occurrence and thereafter, the statement of victim was recorded under Section 164 of the Cr.P.C. in which she disclosed the name of the petitioner.

Patna High Court Cr.Misc. No.47370 of 2016 (3) dt.13-01-2017 2/2 Petitioner is in jail custody since 13.08.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Bhojpur at Ara in connection with POCSO Case No. 03 of 2016 arising out of Pawana P.S. Case No. 09 of 2016.
