The petitioner seeks regular bail in connection with Hiramma P.S. Case No. 42 of 2018 for the offences punishable under Sections 363, 366(A), 376 of the Indian Penal Code and Section 4 of the POCSO Act.
The allegation is regarding the petitioner having taken away the daughter of the informant after abducting her from her house and thereafter, the victim girl had become traceless. The learned counsel for the petitioner, referring to the statement made by the victim girl under Section 164 Cr. P.C. before the learned Magistrate, has submitted that the victim girl has stated that she had voluntarily travelled with the petitioner to Bangalore where they had solemnized marriage and stayed
Patna High Court CR. MISC. No.49793 of 2019(3) dt.27-09-2019 2/2 there as a husband and wife and further she wants to live with her husband. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 01.04.2019.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge cum Special Judge 1st, Sheohar in connection with Hiramma P.S.
