At the very outset and without going into the detailed merits of the matter, Mr. Rajendra Prasad Singh, learned senior counsel appearing on behalf of the petitioner, informs that Appeal No. 39/2015 has been filed on 23.11.2015 before the Hon'ble Chancellor pursuant to the order of this Court dated 04.11.2015 passed in CWJC No. 20483 of 2014 (Dr. Pramod Kumar Singh Vs. Veer
Patna High Court CWJC No.3480 of 2017 dt.07-09-2017 2/2 Kunwar Singh University & anr.).
3. In the above view of the matter, therefore, this Court is not inclined to interfere in the matter at this stage as two parallel proceedings cannot continue for the same relief.
4. The writ petition is accordingly disposed of with liberty to the petitioner to move for early hearing of the aforesaid pending appeal. In case however the said appeal remains undisposed of within a period of three months after request is made by the petitioner, he will be at liberty to approach this Court for appropriate relief.
