JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-10-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 409, 420, 467, 468/34 of the Indian Penal Code.

It is alleged against the petitioner that being Panchayat Sachiv, had committed irregularities in purchase of equipment of open gym and by showing forged documents the petitioner and the Mukhiya of Gram Panchayat Raj, Laguraon Bilandpur have misappropriated Rs. 33,41,290/-.

Patna High Court CR. MISC. No.55979 of 2023(3) dt.12-10-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. It is further submitted that the works were executed after approval by Aam Sabha as well as the executive committee of the Panchayat and thereafter the said resolution was sent to the concerned officer for approval and only after the approval, the schemes were started and all the payments were made through cheques only. The articles were purchased on the basis of quotation and the order was given to the lowest bidder. The petitioner has not misused a single paisa for his personal use and gain and the equipments have already been fixed in several schools and are functional. The petitioner is languishing in custody since 13.06.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period

Patna High Court CR. MISC. No.55979 of 2023(3) dt.12-10-2023 3/3 under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Mahua P.S. Case No. 64 of 2023.
