The Petitioner apprehends his arrest in Jehanabad P.S. Case No.540 of 2016 instituted for the offence under Section(s) 341, 323, 307, 379, 504/34 Indian Penal Code and Section 27 of the Arms Act.
It has been submitted on behalf of the petitioner that the occurrence took place on account of land dispute. The petitioner is alleged to be an order giver.
From the written report, it appears that besides the allegation of order giver, there is no allegation of any overt act against the petitioner.
In the facts and circumstances of the case, prayer of
Patna High Court Cr.Misc. No.112 of 2017 (3) dt.21-02-2017 2/2 the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Jehanabad P.S. Case No.540 of 2016, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, subject to the conditions as laid down under Section 438(2) Cr. P. C.
