11-01-2017 Notices had been issued to the sole respondent in this matter with regard to the civil review application as well as limitation petition. Notice has been validly served, but none has appeared.
Having considered the matter, delay in filing the civil review application is condoned.
Heard learned counsel appearing for the civil review petition. Limits of filing of this review application is only to the order wherein cost of Rs. 1,00,000/- (Rupees One Lac) has been awarded to be paid by the review petitioner to the respondent.
Having considered the matter, in our view,
Patna High Court C. REV. No.29 of 2016 (3) dt.11-01-2017 there being no facts justifying the imposition of such heavy cost in an inter-party matrimonial dispute. We recall that part of the order and modify the same reducing the cost of Rs. 1,00,000/- (Rupees One Lac) to Rs. 10,000/- (Rupees Ten Thousand) to be paid to the respondent within ten days.
We would further direct that the maintenance, if any, fixed by any court be paid, failing which the court which has awarded maintenance would be at liberty to take such measure as are available in law. With this observation, this civil review application stands disposed of.
