JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-03-2018 The petitioner seeks modification of the order dated 14.07.2014 passed in Cr. Misc. No. 18914 of 2014 whereby he was granted anticipatory bail.

By the aforesaid order, the petitioner was granted anticipatory bail subject to the condition that he would surrender before the Court below within eight weeks of the passing of the order and deposit rest Rs. 9,00,000/-(nine lakhs) under protest.

Learned counsel for the petitioner has submitted that petitioner is handicapped by eighty percent and after passing of the order, he again fell down, resulting in serious injuries to him. Because of his inability to surrender before the Court below, he could not obey the orders of this Court in letter and

The petitioner, however, is even today is ready to deposit the aforesaid amount of Rs. 9,00,000/-(nine lakhs), but subject to his every rights and contentions remaining in violate in this case.

For the reasons stated before this Court, the order dated 14.07.2014 passed in Cr. Misc. No. 18914 of 2014 is modified to the extent that the petitioner shall now be required to surrender before the Court below within a period of six weeks from today and deposit rest Rs. 9,00,000/-(nine lakhs), when he shall be released on bail on his furnishing bail bond of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Birpur/concerned Court in connection with Pratapganj P.S. Case No. 56 of 2011. The other condition in the order of his remaining physically present before the Court below till disposal of the case shall subsist.

The order dated 14.07.2014 passed in Cr. Misc. No. 18914 of 2014 stands modified to the extent indicated above. The application stands allowed.
