The Petitioner is apprehending his arrest in a case registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

Nilam Kumari, the sister of the informant, died within one and half years of her marriage in her matrimonial house in unnatural circumstances. There is allegation of demand of dowry and torture for the same soon before her death. Allegation of the prosecution is that the victim was poisoned by her in-laws; whereas the in-laws including the petitioner submit that the death was due to snakebite. The case-diary reveals that the viscera report is not there.

No.52140 of 2016 (3) dt.28-01-2017 2/2 Considering the facts and circumstances of the case especially when the presumption is against the petitioner, I am not inclined to grant anticipatory bail to the petitioner in connection with Pakribarawan Police Station Case No. 51 of 2016, pending in the Court of Mr. N.K. Singh, Judicial Magistrate, 1st Class, Nawada/Successor Court.

Accordingly, the prayer for anticipatory bail is rejected. (Birendra Kumar, J) Mkr./- U T
