The petitioners apprehend their arrest in connection with Alamnagar P.S. Case No. 129 of 2014 registered for the offences punishable under Sections-120(B), 323, 419, 465, 466, 467/504 of the Indian Penal Code.
Allegation is of conspiring and executing forged sale deed of the land of the informant in favour of petitioner No. 2. Petitioner No. 1 is husband of petitioner No. 2 and petitioner No. 3 is identifier on sale deed.
Submission of learned counsel for the petitioners is that petitioners are purchasers and have not executed any sale deed
Patna High Court Cr.Misc. No.21660 of 2018 (2) dt.01-05-2018 rather the sale deed was executed by Naval Singh on which, one Shyam Lakhan Singh is identifier. Naval Singh and Shyam Lakhan Singh have already been granted privilege of anticipatory bail by a coordinate bench of this court vide order dated 20-122017 passed in Cr. Misc No. 61627 of 2017. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioners, be released on bail on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj in connection with Alamnagar P.S. Case No. 129 of 2014, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
