JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Barhara P.S. Case no. 211 of 2016 registered under Sections 461, 379, 120B and 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that petitioners have got no criminal antecedent. They have falsely been implicated in this case with a view to put pressure upon them to grab their landed property. There is no eye witness to the alleged occurrence and nothing has been recovered from the possession of the petitioners.
Patna High Court Cr.Misc. No.237 of 2017 (4) dt.10-02-2017 2/2 Learned A.P.P. has opposed the prayer for anticipatory bail of the petitioner by submitting that petitioners are named in the F.I.R. and witnesses have supported the prosecution case in the case diary.
Having considered facts and circumstances of the case, let above named petitioners, in the event of arrest or surrender before the learned court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea, in connection with Barhara P.S. Case no. 211 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
