The petitioner apprehends his arrest in Jogbani P.S. case No. 144 of 2019 registered under Section 30(a), 38(i) of the Bihar Prohibition & Excise Act.
The informant, In-charge of SSB, alleged that two persons were coming on a motor cycle. When the motor cyclists were asked to stop one person fell down with the motor cycle but another person fled away. The apprehended accused disclosed his name as Ranjit Yadav. Ranjit Yadav disclosed the name of petitioner as the person who managed to flee away. The petitioner and Ranjit Yadav were carrying 660 bottles each containing 300 ml Nepali liquor and huge quantity of liquor was recovered.
The learned counsel for the petitioner submits that

No.49693 of 2019(2) dt.08-08-2019 2/2 name of the petitioner figured in the case on the disclosure made by Ranjit Yadav but it appears that petitioner and Ranjit Yadav were carrying huge quantity of Nepali liquor on the motor cycle but the petitioner managed to flee away and Ranjit Yadav was apprehended. The SSB recovered 660 bottles of Nepali liquor from their possession.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
