Mr. Sri Satyavarat Verma ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-04-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Khaira P.S. Case No. 137 of 2015 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.

The allegation is regarding the accused persons assaulting the informant and his brother and there is direct allegation in the F.I.R. as against the petitioner herein. The learned counsel for the petitioner submits that the police, during the course of the investigation, has found the case as against the petitioner herein to be false inasmuch as he is a student living at Patna and in such view of the matter, the police has submitted final form. Patna High Court Cr.Misc. No.8120 of 2018(3) dt.03-04-2018 2/2 made by the informant, the present case is being prosecuted before the concerned court. It is further submitted that the petitioner is having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Jamui in connection with Khaira P.S. Case No. 137 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The petitioner is directed to appear before the concerned court on each and every date and in the event of two consecutive defaults, the present privilege of the anticipatory bail shall stand cancelled automatically.
