This is an application for grant of anticipatory bail in connection with Babubarhi P.S. Case No. 262 of 2018 (CRI No. 2530 of 2018) registered for the offence punishable under Sections 304(B) /34 of the Indian Penal Code. The allegation is regarding the accused persons including the petitioner herein having killed the victim lady on account of non-fulfillment of the demand of dowry.
The learned counsel for the petitioner submits that the petitioner is the brother-in-law of the deceased lady and the fact is that the mother-in-law and the father-in-law have already been granted regular bail by an order dated 17.10.2019 passed by a coordinate Bench of this Court in Criminal Miscellaneous No. 63894 of 2019. The
Patna High Court CR. MISC. No.50559 of 2019(4) dt.20-11-2019 2/2 petitioner is stated to be having a clean antecedent. Having regard to the facts and circumstances of the case, as also considering the fact that the father-in-law and the mother-in-law have already been granted regular bail, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Madhubani in connection with Babubarhi P.S. Case No. 262 of 2018 (CRI No. 2530 of 2018), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
