The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 456 and 120B/34 of the Indian Penal Code.

The prosecution case is that the informant got information by Ramnandan Mnadal, the care taker of Indian Medical Association, Munger Branch that all the articles of the I.M.A. building, Munger has been removed by the petitioner and using the place in question as his shop.

It is submitted by learned counsel for the petitioner that the petitioner is under an agreement was running shop in I.M.A. building and was making payment of the rent, hence, in the background of tenancy dispute the accusation has been levelled.

Patna High Court Cr.Misc. No.46293 of 2016 (2) dt.22-10-2016 2/2 A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 41 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
