This is an application for grant of anticipatory bail in connection with Daniyawan P.S. Case No. 101 of 2017 registered for the offence punishable under Sections 341, 323, 307, 379, 354(B), 504, 506 and 34 of the Indian Penal Code. The allegation is regarding assault of one Nagina Devi by the accused persons including the petitioner herein, however, the injuries found on the person of the said Nagina Devi are simple in nature.

The learned Senior Counsel for the petitioner submits that on account of village politics, the petitioner has been falsely implicated in the present case and in any view of the matter, the injuries sustained by the said Nagina Devi are simple in nature.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City in connection with Daniyawan P.S. Case No. 101 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
