Petitioner, who is in custody, seeks bail in connection with Jurawanpur P.S. Case No. 6 of 2019 registered for the offence punishable under Sections 363, 366(A), 379, 34 of the Indian Penal Code.

Informant is the father of victim girl, who has stated in his written complaint that on 20.01.2019 at 6:00 PM his daughter Renu Kumari aged about 16 years has been enticed away by the FIR named accused who belong to same family. It has been submitted on behalf of petitioner that he is brother of co-accused Sarla Kumar who had love affair with the victim girl and both of them have fled away without any knowledge or information to the family. Patna High Court CR. MISC. No.53463 of 2019(3) dt.01-10-2019 2/3 stated that the victim girl has fled away alongwith cash and ornaments kept in her house. Petitioner is a married person having family who is residing separately with co-accused Sarla Kumar and has nothing to do with the affair of daughter of informant and his brother. Petitioner has no criminal antecedent and is in custody since 29.05.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 8th, Vaishali at Hajipur, in connection with Jurawanpur P.S. Case No. 6 of 2019 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel his bail bond.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
