The petitioners apprehend their arrest in Amnour P.S. case No. 128 of 2015 under Section 307, 379/34 and other sections of the Indian Penal Code.
Kaushalya Devi, the informant, named the petitioners along with Binod Mahto and alleged that they scaled over the boundary of her house and entered into her house. Binod Mahto is alleged to have assaulted the informant and Manoj Mahto, petitioner No.2, snatched earring of the informant. The learned counsel for the petitioners submits that police after investigation found the case true only against Binod Mahto, son of petitioner No.1, and submitted final form finding
Patna High Court Cr.Misc. No.8268 of 2018 (2) dt.17-02-2018 2/2 the case false against the petitioners.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saran at Chapra in connection with Amnour P.S. case No. 128 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
