The petitioner seeks bail in connection with Tandwa P.S. Case No. 77 of 2018 registered for the offence punishable under Section 304(B), 34 of the Indian Penal Code. Prosecution case in brief is that marriage of the daughter o the informant, namely, Tetari Devi was solemnized with the accused petitioner in May, 2018 according to hindu rites and rituals. After marriage, the husband of Tetar Devi, who is usually making demand of motorcycle on expression of his inability due to poverty by the informant, the accused persons
Patna High Court CR. MISC. No.53232 of 2019(3) dt.20-11-2019 2/3 tortured to the daughter of the informant and on 25.10.2018, one villager of the Sasural of his daughter, informed to the informant that the accused persons has committed murder of his daughter, through, burning. On which, he reached at the matrimonial house of his daughter. Where he found that his daughter was lying dead and the accused persons were fled away. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged. He has been falsely concocted in this case. At the time of alleged occurrence, no body was at home. Deceased was alone at the home and neighbourers informed the father of petitioner about the incident. At that time, father of the petitioner Tipu Ram was on field regarding agriculture work..
There is not even iota evidence against the petitioner. The informant either on suspicion or with ulterior motive has lodged this case. Learned counsel for the petitioner further submits that the petitioner has no any criminal antecedent and the charge sheet has been submitted under Section 306 of the I.P.C. The petitioner is in jail custody since 12.06.2019.
In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like
