====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 16-04-2018 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are apprehending their arrest in connection with Complaint Case No. 2485(C)/2010 registered for offences under sections 420, 406, 120B of the Indian Penal Code.

As per allegation made in the complaint petition, the Complainant gave Rs. 61,450/- by way of advance to the present petitioners for purchase of land, thereafter, the agreement deed for sale was executed on 24.8.1995. After delay

Patna High Court Cr.Misc. No.9289 of 2018(3) dt.16-04-2018 2/2 of fifteen years, a complaint petition has been filed by the Complainant making an allegation that neither the sale deed has been executed nor the money has been returned to him. The delay itself makes the petitioners entitled to anticipatory bail.

Looking to the entire facts and circumstances of the case, let the petitioners, namely, Vibha Devi and Satendra Kumar Singh @ Satyendra Singh, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Judge XI cum Additinal Cheif Judicial Magistrate, Patna in connection with Complaint Case No. 2485(C) of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
