2. The petitioner is in custody in connection with Kursela P.S Case No. 14 of 2025 from the Court of learned CJM, Katihar registered for the offences punishable under Sections 309(4) of the BNS.
3. As per allegation in the FIR, petitioner has run away with the money amounting Rs. 10,48,400 of the informant.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner is the tractor driver of the
Patna High Court CR. MISC. No.52496 of 2025(3) dt.15-10-2025 2/2 informant. It is also submitted that petitioner is in judicial custody since 15.01.2025 and petitioner has got no criminal antecedent as stated in para 3 of the bail petition.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR, case diary and impugned order it appears that, petitioner has confessed his guilt in his statement and looted amount is also recovered from the petitioner.
7. Considering the aforesaid facts and circumstances of the case this Court is not inclined to grant bail to the petitioner. Hence, prayer for regular bail of the petitioner is hereby rejected.
8. However, petitioner may renew his prayer for regular bail before the trial Court after completion of one year of custody.
