Petitioner apprehends arrest in connection with Salkhua P.S. Case No.67 of 2017 registered for the offences under Sections 307, 333, 353, 393, 120(B)/34 of the I.P.C. and Sections 25(1-b)A, 26, 27, 29 and 35 of the Arms Act.
It is alleged that the informant, who is police officer, saw three persons in suspicious condition and when he proceeded with other police officials to interrogate them, they started fleeing away. Out of them, one miscreant opened fire at the informant but it did not hit anybody. The accused (Hemant Kumar Sajan), who opened fire, was apprehended by police and he disclosed the names of other two miscreants. It has been
Patna High Court Cr.Misc. No.21916 of 2018 (2) dt.27-04-2018 submitted that except confessional statement of co-accused, there is nothing against this petitioner. The petitioner has clean antecedent having omnibus allegation.
The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioner in the event of arrest or surrender before the learned court below within six weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the likewise amount each to the satisfaction of learned A.C.J.M. II, Saharsa in connection with Salkhua P.S. Case No.67 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
