The petitioner apprehends his arrest in Nautan P.S. case No.81 of 2016 under Section 272, 273, 34 of the Indian Penal Code and under Section 47 53(B) (C) of the Bihar Excise Act, 2016.
The informant, S.H.O. of Nautan P.S., alleged that one vehicle was intercepted and driver of the vehicle was apprehended. The apprehended accused disclosed his name as Sanjay Ram. From the vehicle 1230 pouches of country made wine was recovered. Sanjay Ram disclosed that country made wine was to be delivered to Abhimanyu Singh, the petitioner. The learned counsel for the petitioner submits that petitioner has no manner of concern with the country made wine
Patna High Court Cr.Misc. No.46875 of 2016 (2) dt.15-12-2016 2/2 and he has falsely been implicated in the case at the instance of the driver.
Considering the fact that nothing has been recovered from the possession of the petitioner rather name of the petitioner was disclosed by Sanjay Ram, driver of the vehicle, and from whose possession country made wine was recovered, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIX, Siwan in Nautan P.S. Case No. 81 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
