The petitioner apprehends her arrest in connection with Keoti P.S. Case No.73 of 2017 registered under Sections 363, 366/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that so far as this petitioner is concerned, she is aged about 74 years and happens to be the grand mother of accused Shankar Mukhiya, who has allegedly eloped with the victim girl Radha Kumari. Learned counsel submits that it is a case of false implication of an old aged lady only because she happens to be the grand mother. Learned counsel submits that the petitioner is ready and willing to abide by the terms and conditions for grant of anticipatory bail.
Patna High Court Cr.Misc. No.7172 of 2018 (2) dt.17-02-2018 2/2 Learned A.P.P. for the State is present.
Considering the facts and circumstances that no specific role has been alleged against this petitioner in the matter and that she is aged about 74 years and there is no chance of her evading the trial, I am inclined to grant anticipatory bail to this petitioner. In case of her arrest/surrender before the court below within four weeks, let the above named petitioner, namely, Ghurni Devi, be enlarged on bail on furnishing bail bonds of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Keoti P.S. Case No.73 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
