JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Sakra P.S. Case No. 239 of 2015 registered under Sections 304(B) and 201/34 of the I.P.C. pending in the Court of C.J.M., Muzaffarpur.

The accusation is of killing of daughter of the informant due to non-fulfillment of demand of dowry by her husband and in-laws family members and later on, disposed of the dead body.

Learned counsel appearing on behalf of the petitioners submits that petitioners happen to be father-in-law,

Patna High Court Cr.Misc. No.47279 of 2015 (2) dt.04-02-2016 2/2 mother-in-law, sister-in-law and brother in-law of the deceased. They have falsely been implicated in this case by the informant, father of the deceased.

Learned counsel appearing on behalf of the State vehemently opposed the prayer of the petitioners. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioners. Accordingly, the application for grant of anticipatory bail is rejected. However, petitioners are directed to surrender before the Court below within a period of four weeks and pray for regular bail, which shall be decided on its own merit without being prejudiced by the present order.
