2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 457 and 380 of the Indian Penal Code.
3. As per the prosecution case, petitioner is alleged to have committed theft of mobile and cash amounting to Rs.1,50,000/- from the house of the informant.
4. Learned counsel for the petitioner submits that petitioner is falsely been implicated in this case. The petitioner has not committed any such offence. He further submits that petitioner is implicated in this case only on the basis CCTV camera footage and no article has been recovered from the possession of the petitioner. Petitioner has no criminal antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. I/c, Katihar, in connection with Katihar Town P.S. Case No.403 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
