JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-09-2016 The petitioner being father of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that accusation is omnibus and general against the entire in-laws family including the petitioner. The thrust of accusation is against the husband of the informant. The petitioner is a retired government servant aged about eighty years.

Considering the aforesaid facts, let the

Patna High Court Cr.Misc. No.40585 of 2016 (2) dt.20-09-2016 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Mahila P.S. Case No. 58 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
