The petitioners seek bail in a case registered under Sections 332, 333, 353, 323, 504, 307, 427 of the Indian Penal Code and Section 30(a) and 45 of the Bihar Prohibition and Excise Act. 2016 and 7 of the Prevention of Damage to Property Act, 1984.
The prosecution case in short is that 5 litres of illicit liquor kept in a Bolero was recovered by the police and while the police proceeded with recovered Bolero, the accused persons started pelting stones which resulted into injuries to the persons. It has been submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.52228 of 2019(2) dt.22-08-2019 2/2 petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 13-06-2019. 15 litres illicit liquor is said to have been recovered from the house of co-accused. General and omnibus allegation has been made against the petitioners. No specific overt act is alleged against the petitioners.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Manpur P.S. Case No. 13 of 2019.
