JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

This application is for grant of anticipatory bail for the offence under Sections 307 and other Sections of the Indian Penal Code.

The allegation against the petitioner is that he is named in the FIR and there is allegation against the petitioner that he assaulted one Birendra Ram.

It has been submitted on behalf of the petitioner that some altercation took place but there was no intention to kill the injured person.

It has also been submitted that there is allegation against the petitioner of assault but the injury was found simple in nature.

Having heard both sides and in view of the facts as stated above as well as the injury report, which is simple in nature, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Bhojpur at Ara in connection with Tarari P.S.Case No.54 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
