Petitioners claim to be landless persons and are said to have constructed houses over Gair Majarua Sarv Sadharan land. They want the land to be settled in their favour. According to them, Gram Sabha has also recommended settlement of land in their favour.
No statutory provision has been brought to this Court's notice nor any scheme or policy of the State Government under which the settlement can be made in favour of the petitioners.
I find it difficult to hold petitioners a privileged tenant
Patna High Court CWJC No.16067 of 2019(2) dt.07-08-2019 2/2 within the meaning of Bihar Privileged Persons Homestead Tenancy Act, 1947 in absence of any person on whose land they are said to have constructed their houses.
It will, however, be open to the petitioners to raise their grievance before the appropriate authority, if, according to them, they occupy no land at all other than the said Gair Majarua Sarv Sadharan land over which they are said to have constructed their houses.
This application is disposed of with the aforesaid observation.
