Learned counsel for the petitioner is directed to remove the defect (s), as pointed out by the office, within a period of four weeks.
The petitioner seeks bail in connection with Basopatti P.S. Case No. 169/2020 registered for the offence under Sections 341, 342, 323, 324, 307, 354(B), 379, 504 and 506/34 of the I.P.C.
The prosecution case, in brief, is that on 24.07.2020 at about 7.00 A.M., in the morning, the informant alongwith his mother and cousin sister went to field for sowing paddy crops and while he was returning after taking breakfast and drinking water near the tap of Binde Mukhiya, on the way, the accused
Patna High Court CR. MISC. No.54416 of 2022(2) dt.21-12-2022 2/3 persons took away his mother and cousin sister in a house and tried to commit rape upon them. On hulla, the informant and the owner of the land arrived there and found them in naked condition. On request made by the informant, the accused persons abused and assaulted with weapons, as a result of which, he sustained injury. When the villagers assembled there, the accused persons called through phone to his villagers then his villagers came there with arms to rescue the accused persons and assaulted with arms.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.05.2022. He has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific overt act has been alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
